We bring to you our April 2024 edition of the nota bene Update.
In the context of the Hon’ble Supreme Court’s view, on the prolongation of criminal and civil trial due to stay orders, in Asian Resurfacing of Road Agency Private Limited & Anr. v. Central Bureau of Investigation, that all the interim orders should be automatically vacated after the expiry of six months, we have analysed the Hon’ble Supreme Court’s reconsideration of the said issue in High Court Bar Association, Allahabad v. State of Uttar Pradesh overruling the decision in Asian Resurfacing (supra).
In this edition of the nota bene, we attempt to decipher the principles as laid down by the Constitution bench of the Hon’ble Supreme Court in High Court Bar Association, Allahabad (supra) and assess its practical implication on pending and future litigations.
