The Practice

AQUILAW’s Insolvency, Restructuring & Bankruptcy practice advises creditors, corporate debtors, resolution professionals, resolution applicants and other stakeholders through the entire insolvency life cycle, from early distress signalling and contingency planning to resolution, liquidation or restructuring. Our lawyers regularly appear before the National Company Law Tribunal (NCLT) and the National Company Law Appellate Tribunal (NCLAT) and combine that litigation strength with commercial judgment on deal structuring, making us well placed to advise on both the legal process and the underlying business outcome.

We advise across sectors and situations, from pre-insolvency and out-of-court restructuring through to formal proceedings under the Insolvency and Bankruptcy Code, 2016, and we work closely with our banking & finance, corporate-commercial and dispute resolution teams so that a company’s financing, contractual and litigation exposure is addressed as part of a single, coordinated strategy rather than in silos.

  7. Cross-border insolvency and group insolvency issues, including coordination with overseas creditors and proceedings.
  8. Liquidation and voluntary liquidation advisory, including asset realisation and distribution.
  9. Advising on personal guarantee proceedings and related enforcement issues under the IBC.
